Notifications that do not comply with all of the requirements above may not receive a response or be acted upon. We recommend that you consult a legal professional before submitting a notification.
3. Counter-Notification
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. To be effective, your counter-notification must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your full name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of a competent judicial authority and that you will accept service of process from the person who provided the original notification or an agent of that person.
Counter-notifications should be sent to the designated agent using the contact information listed in Section 2 above.
4. Repeat Infringer Policy
Valzora has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice or whose content has been removed from our services more than twice.
5. Modifications to User-Submitted Content
Valzora may, at its discretion, remove or disable access to any content that is claimed to infringe copyright, pending resolution of the matter. We reserve the right to make this determination independently and without prior notice to the submitting user.
6. False Notifications
Be aware that submitting a materially false notification or counter-notification may result in liability for damages, including costs and legal fees. If you are unsure whether material infringes your copyright, we strongly recommend seeking legal counsel before submitting any notice.
7. Non-Infringing Uses
Valzora acknowledges that not all reproduction or use of copyrighted material constitutes infringement. Uses that may qualify as fair use, or equivalent doctrines recognized in applicable law, will be considered when evaluating infringement claims. However, it is not our role to adjudicate whether a particular use qualifies as fair use, and we may act on a properly submitted notice regardless.
8. Third-Party Content
Our services may contain links to or embed content from third-party platforms. Valzora does not control and is not responsible for content hosted on external services. If you believe content on a third-party platform infringes your copyright, you should direct your notification to that platform directly.
